Back in 1985, a study was conducted by the American Society of Anesthesiologists. At this time, Anesthesiologists were at the center of 7.9 percent of all malpractice lawsuits. As a result, the Society examined 35 insurance companies, issued standards and procedures in an attempt to avoid injuries.

Over the last few years in Kentucky, the number of medical malpractice lawsuits has risen. Healthcare providers are now paying more than ever for medical malpractice insurance premiums.

Last year, a survey was conducted by Medscape. This survey showed that the nature of nearly 47 percent of these lawsuit derived from abnormal injuries such as neurological or nerve damage.

There has also been an payout increase of 4.4% when compared to 2014. Unfortunately, 30 percent of all medical malpractice payouts were for wrongful death, and 18 percent of plaintiffs suffered from severe permanent injuries or disabilities. In Kentucky misdiagnosis is one of the most common causes for medical errors at 33 percent, followed by surgery at 24 percent. Although medical malpractice cases are hard to win, last year plaintiffs received judgments that were more than 17 times greater than those from tort cases.
